Virginia Types of Traffic Penalties

Many people brush off traffic citations as minor inconveniences, but the reality is that a traffic citation almost always comes with some sort of penalty. In some cases, these penalties can be severe, especially when the citation is ignored or not dealt with properly. Common Virginia traffic citation penalties

Most people just think of traffic tickets as coming with fines that they can pay and be done with the issue. However, it is important to realize that most traffic violations result in points counting against their license in the Commonwealth of Virginia. When a person accumulates enough points, their license can be suspended or revoked.

However, many traffic violations come with more penalties than just points and fines. Some Virginia traffic violations are considered misdemeanors. Some of the most common misdemeanor traffic offenses include the following:

  • Driving on a suspended license: This is considered a class one misdemeanor in Virginia and comes with a penalty of up to one year in jail, fines of up to $2,500, and a 90-day license suspension.
  • Driving on a revoked license: This is also considered a class one misdemeanor that has similar penalties to the infraction mentioned above. A third offense of driving on a revoked license would be considered a class 6 felony in Virginia.
  • Reckless driving: There are a number of different violations that can result in a reckless driving citation, including driving more than 20 mph over the speed limit, driving more than 80 mph regardless of the posted speed limit, racing, and more. This is considered a class one misdemeanor in Virginia with penalties similar to driving on a suspended license.
  • Driving under the influence (DUI): Driving under the influence of alcohol (at a blood alcohol concentration level of .08% or higher) can result in a class one misdemeanor charge. Penalties for this offense can include up to one year in jail, fines of up to $2,500, license revocation, a requirement for an ignition interlock device (IID), and more.

Some serious traffic violations could be considered a felony. This can include third offense DUI convictions, hit and run accidents when a victim is seriously injured or killed, intentional reckless driving, and more.

In Southampton County, the towns of Boykin and Courtland are areas where we see many of these citations arise, as well as in Emporia, where I-95 and I-58 come together.
