Contested or uncontested divorces in Virginia

A divorce is going to be either contested or uncontested. When a divorce is uncontested, it means that they have resolved all matters related to the separation. This includes all areas of divorce that we help clients handle, such as:

  • Division of assets: Virginia is considered a “marital property” state in which all property the couple acquires after the official date of marriage is considered jointly owned. Virginia law requires an equitable distribution of property in the event a divorce occurs.
  • Child custody and visitation: Child custody can become complicated in a Virginia divorce. Both physical custody and legal custody of a child need to be determined (where the child will live and which parent will have the right to make important legal decisions regarding the child). Non-custodial parents will have the right to visitation with their child in most circumstances.
  • Spousal support: This is sometimes referred alimony, and is the payment a spouse of lesser means may receive from the other spouse. Spousal support payment formulas take various factors into account and the attorney will work to ensure that all parties are treated fairly in this situation.
  • Child support: Child support may be ordered to be paid by one parent to the other to assist with the cost of raising a child. Under Virginia law, both parents are required to continue supporting their children after a divorce or separation.

A divorce will be considered contested if the two parties disagree on any of the issues that need to be finalized. If your divorce is contested, you do need to consider speaking with a skilled family law attorney in your area. At Randall, Page & Bruch, P.C., our job is to ensure that you are treated fairly throughout the entire separation and divorce process. A divorce is much more than just the dissolution of marriage. This is a family law matter that encompasses various life-changing factors. You need to be looked after through the entire process.
